1.6 Limitation of Liability

Peak Performance Dispatch Services is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the services in the 12 months preceding the claim.

1.7 Indemnification

You agree to indemnify and hold harmless Peak Performance Dispatch Services, its officers, directors, employees, and agents from any claims, damages, or expenses (including attorney's fees) arising from your use of our services or violation of these terms.

No mobile information will be shared with any third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with or obtained by any third parties.
